Taklik talak is the talak of the husband that is hung on a certain nature, which when a certain nature is realized then fall talak the husband. Taklik talak according to the provisions of article 1 letter (e) Compilation of Islamic Law (KHI) is “agreement spoken by the prospective bridegroom after the marriage certificate stated in the marriage certificate in the form of a talak promise hung to the a certain situation that may occur in the future”.

Talak's taklik agreement is actually not an agreement that must be held in every marriage, but once talak taklik has been promised it can not be revoked. So sighat taklik talak is not to be read in every marriage, but if the wife asks the husband to read the talak then the husband must read the talak taklik.

Taklik talak in the Indonesian version of fikih is different from the talak taklik set in the book of fikih (yellow book).

In the study of the book of jurisprudence, if certain conditions are required in the talaq taklik it occurs then by itself the talak falls. Mentioned in the book of al-Sharqowiy ‘Ala at-Tahrir juz 2 pages 302: “Man ‘alaqa thalaqa bisifatin waqa’a biwukuiha ‘amalan bi muqtadhallafdhi, wang (husband) who hang talak on a trait, to a nature, so the fall of the talisman with the realization of that nature in accordance with his speech it”. So the talisman immediately fell as soon as the promised/dependent nature was realized.

Different provisions in the Indonesian version. If certain conditions are required in the talak taklik it really happened, then in order for the talak really fell, the wife must submit the question to the Religious Court (PA). If you do not complain to the PA, then the husband's talak will forever not fall.

If we look at it, in the talaq taklik sighat it contains 2 conditions, namely alternative conditions and cumulative conditions. 

Alternative conditions must be violated by the husband while cumulative conditions must be carried out by the wife. 

The alternative requirement is numbers 1 to 4. If the husband has done one of the numbers 1 to 4 or all, then the husband has violated the alternative talak taklik.

But that is not enough condition for the fall of the husband's talaq. For the fall of the husband's talaq then the wife must meet the cumulative conditions, namely 1. the wife is not ridho 2. filed a lawsuit on PA 3. the lawsuit was accepted and 4. the wife handed over the iwadh money Rp.10.000,-. These four cumulative conditions must be met. If these 4 cumulative conditions have been met all, then fell the talak of one husband.

Lay people sometimes come to the PA to ask for divorce papers on the grounds that her husband has violated one of the alternative terms of talak taklik talak, for example her husband has not given her a living for more than 3 months. Of course, it will not be fulfilled by the PA.

This view of the lay community is wrong as a result of understanding the tactics of talaq in the teachings of the yellow book. Because in the yellow version of talaq there are no alternative conditions and cumulative conditions. There are only general terms. The fall of talaq because the husband violates the talaq taklik is immediately occur once the taklik violation occurs.

There are at least 3 differences between talak taklik a la fikih yellow and ala fikih Indonesia, which lies in the terms of talak, types of talak and iwadh.

In the study of the yellow book, the terms of talaq are only one, namely the conditions absolutely. For example a husband says to his wife “if you get out of this house now, then you are stuck”. If the wife then went out of the house, then fell the talak of her husband directly, at that very moment.

Different from taklik talak version of Indonesian fikih. Because in Indonesian jurisprudence the terms of talak are not only alternative terms, but there is a cumulative condition, which must be submitted to the PA by filing a talak taklik lawsuit. If the lawsuit is granted and the wife pays iwadh, then the Court will declare the condition of the taklik has been fulfilled and fall the talak husband. If the process to the PA is not taken, then forever the talak husband will not fall.

The second difference is the type of talaq. If in the study of yellow books, then this talak taklik includes talak raj’i, because the saying is the husband. Talak raj’i is the first, or second, talak. In this talak the husband is entitled to refer to during the wife in the iddah period. So there is a right to refer the husband to the wife who was sentenced to death by the way the husband violated talak taklik. The right of reference is there as long as the wife lives the iddah period.

In the study of Indonesian jurisprudence, divorce due to the violation of talaq taklik belongs to the category of talak ba’ sughra (fighting divorce), even though the fall was the husband's talak.

Bain Sughra talaq is a talaq that should not be referred but may be a new marriage contract with her ex-husband even in iddah.

Why divorce taklik talak is included in talak bain sughra, because for the fall of talak the husband's wife must file a lawsuit against taklik talak to the PA and must pay iwadh. For the fall of the husband's talaq depends on the initiative of the wife.

The fall of the husband's talaq who violated the talak taklik was by the Court. Divorce for talaq taklik violation is talak bain sughra. This is as described in chapter 119 paragraph (2) of the letter c. KHI, “talak bain sughra as mentioned in paragraph (1) is c. talak dropped by the Religious Court”. So because the divorce due to the violation of the talaq that dropped is PA, then the type of talc is ba’in sughra, so that the husband does not have the right to refer to his wife. If there is an agreement to build a household again, it must be with a new marriage contract.

The third difference is iwadh. In the study of the book of yellow jurisprudence, there is no payment of iwadh by the wife in divorce for violations of talaq. If it must be with the condition of the wife to pay iwadh, then it is not a talak taklik divorce, but is called khuluk or talak sugarcane, or, namely the divorce that occurs at the request of the wife by giving a ransom or iwadh to/and on the consent of her husband.

If in Indonesian jurisprudence, the payment of iwadh from the wife to the husband is a cumulative condition of talaq taklik violation. If the wife does not pay iwadh money of Rp.10,000,-, then the husband's talaq will not fall.

Islamic law can be classified into diyani (religious) and qadha’i (yuridis). Islamic law is entirely religious, but only Islamic law which is qadha’i only which requires the power of the State to enforce it.

Islamic law that is religious relies heavily on the obedience of individuals who are subjects of law. Islamic law that is known as the laws in the field of worship, prayer, zakat, fasting and Hajj. While Islamic law which is qadha’i among others are laws in the field of muamalah law, family law and criminal law. In the dispute of buying and selling (economy syari’ah) and husband and wife disputes in the household there is a need for court intervention to try it.
