إذا كان للمرأة أب أو جد فغاب الاب وحضر الجد ودعت المرأة إلى تزويجها نظرت، فان كان الاب مفقودا بأن انقطع خبره ولا يعلم أنه حى أو ميت فان الولاية لا تنتقل إلى الجد، وانما يزوجها السلطان، لان ولاية الاب باقية عليها، بدليل أنه لو زوجها في مكانه لصح، وانما تعذر بغيبته فناب الحاكم عنه‎

It means: “If a woman has a father and grandfather, then the father leaves and there is his grandfather, then the woman asks the grandfather to marry her then be seen; if the father is not known to exist (mafqud) where the news about him is cut off and also not known to live and die, then the guardianship does not move to the grandfather. The one who can marry him is the ruler, because the guardianship of the father still remains over the woman. On the grounds that if the father marries the woman in her place then her marriage contract is valid, just that her absence makes her unable to marry then the judge acts in her place.” (Yahya bin Sharah An-Nawawi, Al-Majmu’ Syarhul Muhadzdzab, [Strue: Maktabah Al-Irsyad, **.], Juz XXVII, p. 259)

From the explanation of Imam Nawawi above it can be understood that a guardian whose existence is unknown and also unknown is still alive or not he is still entitled to be a guardian of marriage for a woman under his guardianship who wants to marry. Its absence at the time of kabul ijab does not make its guardianship rights move to others who can also be guardians in the next order. Therefore when the guardian cannot marry because of his absence then the marriage can still take place with the ruler as his guardian or commonly called the guardian of the judge.

This is when the guardian is not known to exist.

The Guardian of Judges is a marriage trustee appointed by the Minister of Religious Affairs or an official appointed by him, who is given the right and authority to act as a marriage guardian. The new magistrate may act as the guardian of the marriage if the trustee of the nasab does not exist or is unlikely to present him or is not known where he lives or is occult or adlal or reluctant.In the case of the trustee adlal or reluctant, then the new judge may act as the guardian of marriage after the decision of the Religious Court concerning the guardian." Terms of Being a Marriage Guardian
