Zina is even done by teenagers. Zina is also associated with certain momentum such as Valentine’s Day, new year night parties, weeks****national, etc.
Zina is a great sin. Even approaching zina is haram. Allah SWT said: “Do not approach adultery because adultery is a heinous act and a very bad path”(QS al-Isra’: 32).
Allah SWT even associates the sin of adultery with other major sins, namely shirk and murder. His Word :“And those who do not worship any other god with God, and do not kill the soul that Allah has forbidden (killed) except by (excuses) the truth, and do not fornicate. Whoever does so, he will have (revenge) of his (sin) sin, (i.e.,) multiplied the punishment for him on the Day of Resurrection, and he will remain in that torment, humiliated, except those who repent” (QS al-Furqan: 68-70).
In the world, the perpetrator of adultery deserves the punishment of whipping 100 times (for those who have never been married) (QS an-Nur: 2) and exiled for a year (HR al-Bukhari). As for adulterers who are married or have never married but often fornicate are subject to stoning (stoned) to death.
Reportedly, when the Prophet was in the mosque, a man came to him and reported, “Yes the Prophet, I have committed adultery.” Hearing the confession the Prophet turned away from him so that the man repeated his confession four times. Then the Prophet asked, “Are you crazy?” The man replied, “No.” The Prophet asked again, “Are you a muhshan?” The man replied, “Ya.” Then the Prophet ordered to the Companions, “Baw him go and stammer.” (Sr al-Bukhari).
In addition, zina can also invite doom for the community. The Prophet said, “If zina and usury are widespread in a village, then indeed they have justified upon themselves the punishment of Allah (HR al-Hakim, al-Baihaqi and ath-Thabrani).
This Hadith explains that if zina and usury have spread in the midst of a society then it will provoke the descent of the punishment of Allah SWT. Blessings will be deprived of such a society. Conversely, ugliness and damage will continue to plague the community as long as they do not try to prevent the spread of zina and usury while removing zina and usury from community life.
This hadith is also supported by a number of other similar traditions. Among them the hadith of Aisha ra, the Prophet said, “My heart will continue to exist in goodness as long as it has not spread among them the child (result) of adultery. If in the middle they spread children (result) of adultery then Allah almost leveled sanctions (azab) on them.” (SR Ahmed).
The Prophet Muhammad SAW has actually given an ultimatum regarding the rise of adultery in the midst of society. His word : ” When adultery (abuse and conduct****free) is widespread in the community and is done overtly (considered common), is, then infections and deadly diseases that previously did not exist in the days of their ancestors will spread between them” (HR Ibn Majah).
This Hadith also refutes the statements of many people who often state that one of the causes of adultery is due to economic factors or poverty. It is precisely the act of adultery that will plunge the culprit into poverty. And if it even looks to have a treasure, it is only pseudo and temporary. For sure the end will run out without a trace, his property is not blessed.
In the Hereafter, the adulterer deserves a severe punishment in hell. Abu Hurairah ra said that the Apostle SAW once said, “There are three groups of people who will not be seen by Allah ‘Azza wa Jala: adulterous parents, who are not, liar ruler and arrogant poor man.” (HR Ibn Abu ad-Dunya’).
Also narrated from the Prophet SAW that the adulterer will throw himself in the punishment in the Hereafter in a furnace of fire that the top is narrow and the bottom is wide (HR al-Bukhari).
Even the rise of adultery is one of the nearby signs of the coming of the Day of Resurrection. His words:” “Among the nearby signs of the coming of the Day of Resurrection are: the loss of knowledge; the prominence of ignorance; the rampant miras; and the rise of zina.” (Sr al-Bukhari).
Therefore, Islam strictly forbids all things that are close to adultery (eg: courtship, promiscuity) and considers adultery as a vile act and a bad path.
In the Fikih study, zina can be divided into two, first: zina mukhshan, and second: zina ghairu mukhshan.
Zina Mukhshan is an adultery committed by a married person. The phrase “a married” includes a husband, wife, widow, or widower. The had (punishment) imposed on the adulterer mukhshan are
That is: “And (against) the woman who committed a vile deed (adultery) there should be four witnesses among you (who witnessed it).”((QS. An-Nisa’:15)
The confession of the perpetrator of adultery, as described in the hadith Jabir bin Abdillah a. follows:
Meaning: “From Jabir bin Abdullah al-Anshari ra. That a man from the Banu Aslam came to the Messenger of Allah and told him that he had committed adultery. This confession was pronounced four times. Then the Apostle ordered that the man be stoned and the man was muhshan.” (Sr. al-Bukhari)
Some scholars argue that the pregnancy of women without husbands can be used as the basis for the determination of adultery. But Jumhur Ulama’ thinks otherwise. Pregnancy alone without the recognition or testimony of four just persons cannot be the basis for zina determination.
The perpetrators of adultery are already puberty and reasonable
The act of adultery was done without coercion
The perpetrator of adultery knows that the consequences of adultery are had
It has been believed syara’ that the perpetrators of adultery really do vile acts
Kinds of Zina and her Had
In the Fikih study, zina can be divided into two, first: zina mukhshan, and second: zina ghairu mukhshan.
Zina Mukhshan is an adultery committed by a married person. The phrase “a married” includes a husband, wife, widow, or widower. The had (punishment) imposed on the adulterer mukhshan are
The technical application of the stoning penalty is that the perpetrator of zina mukhshan is pelted with a medium-sized stone until it is completely dead. The stone used should not be too small so as to prolong the process of death and punishment. Just as it is not permissible to stoning with a boulder to cause instantaneous death which is why the purpose of “giving a lesson” to adulterers mukhshon is not achieved.
Zina Ghairu Mukhshan is an adultery committed by someone who has never been married. The jurists agree that the had (punishment) for adulterers ghairu mukhshan both male and female is a whip of 100
As for the punishment of exile (taghrib/nafyun) the jurists are at odds.
Imam Shafi’i and imam Ahmad argue that the limit for adulterers ghairu mukhshan is 100 times the guava and exile for 1
Imam Abu Hanifa argued that the limit for adulterers ghairu mukhshan was only to whip as many as 100 Exiles according to Abu Hanifa is only an additional punishment whose policy is fully imparted to the judge. If the judge decides the additional sentence to adulterer ghairu mukhshan, then the exile falls into the category ta’zir not had.
Imam Malik and Imam Auza’i argue that the limit for adulterers of independent men ghairu mukhshan is lashings as many as 100 times and seclusion for 1 year. As for the adulteress of the free woman ghairu mukhshan her limit is only a whip of 100 She is not exiled because the woman is aurat and it is likely that she was abused outside her territory.
The dalil which asserts that adulterer ghairu mukhshan is subject to a 100-time whip and exile is;
The Word of God in the letter of Nur verse 2:
It means: “Women who fornicate and men who fornicate then wander on each of them a hundred times, and do not have mercy on them to prevent you from (running) the religion of God, if ye believe in Allah and the last day, and let (the execution) of their punishment be witnessed by a group of believers.” (QS. An-Nur :2)
The Word of the Prophet SAW:
Meaning: “ From Zaid bin Khalid Al-Juhaini, he said : “I heard the Prophet tell that the one who committed adultery and he was not muhshan, was wracked 100 times and exiled for one year.”(Al-bukhari)
