تعتبر المرأة طالقاً إذا أوقع زوجها عليها الطلاق ، وهو عاقل مختار ليس به مانع من موانع الطلاق كالجنون والسكر ، ونحو ذلك . وكانت المرأة طاهرة طهراً لم يجامعها فيه أو حاملاً أو آيسة

A woman of the status is turned when

When dropping a talaq, the husband is resourceful, not forced, not crazy, not drunk, or anything like that

His wife is holy (not menstruating) and has not been listened to, or is pregnant, or has been menapause.

(Fatawa at-Talak Ibn Baz, 1/35).

مجرد غياب الزوج عن زوجته لا يحصل به الطلاق مهما طالت المدّة

Separation between husband and wife in a long time, has been common since the past. The habits of friends, tabiins who go to war, or migrate to study, or trade, are usually passed over a very long period of time.

In a statement narrated by Baihaqi, it is stated,

كتب عمر إِلى أُمراء الأجناد في رجال غابوا عن نسائهم يأمرهم أن يُنفقوا أو يُطلّقوا، فإِنْ طلَّقوا بعَثوا بنفقة ما مضى

Umar radhiyallahu ‘anhu, sent a letter to the leaders of the army, ordering for the husbands who left his wife, that they give her a living or mental. If they were mentally his wife, they would have to send the ration of bread as long as he left first.

Ibnul Mundzir said that this letter was shahih from Umar ibn Khatab.

(CHR. Baihaqi and al-Albani disheveled in al-Irwa’, 2158).

Even one of the disciples of Imam Malik named Ibnul Qosim, he left his wife in Egypt, to study to Imam Malik in Medina.
