The father marrying his stepdaughter is usually done when his ex-wife is dead. For example, Ahmad married Aisyah who already had a daughter named Maisaroh with her previous husband. As Aisha died, Ahmad wanted to marry Maisaroh, who was his stepdaughter.


Regarding the law of stepfathers marrying his stepdaughter, then the scholars divide it into two forms of law. If the man who is a father has had sex with the mother of the stepdaughter, it is not lawful for him to marry his stepdaughter. In fact he is not only not halal to marry the stepdaughter, but also haram for him to marry the daughters of his children ex-wife.


But if when married to the mother of his stepdaughter he has never received it, then it is lawful for him to marry his stepdaughter, of course with the record he is no longer the husband of the mother, he is no longer the husband of the mother, either because of divorce or because of death.


The provisions of this law by the scholars are based on the word of God in Surah verse 23 following;


وَرَبَائِبُكُمُ اللَّاتِي فِي حُجُورِكُمْ مِنْ نِسَائِكُمُ اللَّاتِي دَخَلْتُمْ بِهِنَّ فَإِنْ لَمْ تَكُونُوا دَخَلْتُمْ بِهِنَّ فَلَا جُنَاحَ عَلَيْكُمْ


(And it is forbidden for you to marry) the daughters of your wife (stepchildren) who are in your care of your wife whom you have interfered with. But if you have not interfered with those wives, then it is okay for you (marry those stepchildren).


The above verse very clearly mentions the fragrance of marrying a stepdaughter whose mother has been listened to. But if the mother of a stepdaughter has never been listened to at all, then the law can marry her stepdaughter. Wallahu a’lam bus shawab.
