...Divorce Law and Iddah Time...

When viewed from the perspective of Indonesian State Law, the divorce will only be recognized if it is done in the Religious Court. The form of talaq speech that is done outside the Religious Court is only considered legal based on religious law.

Referring to this, of course, divorce is done outside the religious court. The marriage bond between husband and wife is still in place. In other words, it has not been interrupted, especially when viewed from the rules of the country.

(In the first episode. Akbar just gave Ara a talaq. Not legally divorce the state with a rolling trial process. This is a law that makes it clear. If at this time, the status of both is still valid in the eyes of the state. That means Ara is still Akbar's wife)

When the word talak has come out of the lips of a husband. The wife must go through the Iddah period. What is Iddah time? What's the law like? 👇

The law of the iddah period is mandatory for every woman who is divorced from her husband, either because she was stabbed or died. This is in accordance with the word of Allah in Surah Al-Baqarah verse 228 which means:

وَٱلْمُطَلَّقَٰتُ يَتَرَبَّصْنَ بِأَنفُسِهِنَّ ثَلَٰثَةَ قُرُوٓءٍ ۚ وَلَا يَحِلُّ لَهُنَّ أَن يَكْتُمْنَ مَا خَلَقَ ٱللَّهُ فِىٓ أَرْحَامِهِنَّ إِن كُنَّ يُؤْمِنَّ بِٱللَّهِ وَٱلْيَوْمِ ٱلْءَاخِرِ ۚ وَبُعُولَتُهُنَّ أَحَقُّ بِرَدِّهِنَّ فِى ذَٰلِكَ إِنْ أَرَادُوٓا۟ إِصْلَٰحًا ۚ وَلَهُنَّ مِثْلُ ٱلَّذِى عَلَيْهِنَّ بِٱلْمَعْرُوفِ ۚ وَلِلرِّجَالِ عَلَيْهِنَّ دَرَجَةٌ ۗ وَٱللَّهُ عَزِيزٌ حَكِيمٌ

Arabic-Latin: Wal-mutallaqatu yatarabna bi`anfusihinna ⁇ ata quru` wa lahunna ayya lahunna ay yaktumna malaqallahu fi ar-mihinna ing kunna yu`minna billashi wal-yaumil-akhir, wa bu'ainkretuhunna a taqqu biraddihinna fi elika in aradu islala, wa lahunna mielullazhi 'alaihinna bil-ma'rinafi wa lir-rijali 'alaihinna darajah, wallahu 'azizun 'sudakim

Meaning: "And the divorced wives (obliged) restrained themselves (waiting) three times quru'. They shall not hide what Allah has created in their womb, if they believe in Allah and the last day. And their husbands are more entitled to return to them in that (time), if they want improvement. And they (the women) have the right to be balanced with their obligations in a proper manner. But husbands have an advantage over them. Allah is All-Mighty, All-Wise" (QS. Al-Baqarah: 228).

(So here it is quite clear with the provisions of the period of iddah in our religion, according to Islam. Even so, we should always crosscheck every source. Including the knowledge that othoor is trying to give.)

This category is also divided into two categories that have their own laws.

First, women who are divorced and have not been spayed. The law is that it is not obligatory to undergo the period of iddah. This is according to the word of God in QS Al-Ahzab: 49:

يَٰٓأَيُّهَا ٱلَّذِينَ ءَامَنُوٓا۟ إِذَا نَكَحْتُمُ ٱلْمُؤْمِنَٰتِ ثُمَّ طَلَّقْتُمُوهُنَّ مِن قَبْلِ أَن تَمَسُّوهُنَّ فَمَا لَكُمْ عَلَيْهِنَّ مِنْ عِدَّةٍ تَعْتَدُّونَهَا ۖ فَمَتِّعُوهُنَّ وَسَرِّحُوهُنَّ سَرَاحًا جَمِيلًا

Arabic-Latin: Ya ayyuhallazina awanu nakusa nakumul-mu`minti ⁇ umma tallaqtumukhunna ming qabli an tamassinahunna fa maka lakum 'alaihinna min 'iddatin ta'taddnaha, fa matti'ekhunna wa sarriipihunna sara saunan jamila

It says: "O you who believe! If you marry the believing women, then you divorce them before you mix them, then there is no time of iddah for them that you need to take into account. But give them muteness and release them in the best way."
