REGRET THE TWINS' FATHER 4

REGRET THE TWINS' FATHER 4
125. Protesting

Three days before the wedding took place, there was a debate between Calista and her extended family about the wedding the family had held for them, but it violates Islamic religious law which rules Islam that prohibits a biological father from marrying his daughter without any legal marriage to the mother of the previous daughter.

"Dad!"

"Yes Calista!"

"Did you not understand our religious law that forbids you from marrying both of us who were born outside of marriage?"

"Dad knows it dear, it's just that dad couldn't possibly open the disgrace in front of the crowd about your status as an out-of-wedlock child." Reza said sadly.

"Dad, please listen to Calista!

Calista wants our families to understand the laws governing marriage for children born outside marriage."

"Please darling!" Reza, who wants to know the clarity of his status, has no right to the marriage of his two daughters.

Calista began to convey the legal rules of the marriage.

"According to Muhammad Abu Zahrah, a child can be said to be valid and can be narrated to his parents must meet three conditions, namely the minimum birth of a child six months from marriage, the existence of a relationship se**ual, and is the result of a valid marriage.

In fikih terminology, there is no term “anak outside of wedlock”. Fiqh scholars use the term child born out of wedlock with an adulterous child.  An adulterous child is a child born as a result of an illegitimate relationship.

Invalid relationship is a body relationship between two people who are not bound by marriage and do not qualify and get along. Children out of wedlock can be divided into two types.

First, the fertilized child is not in a valid marriage, but is born in a valid marriage.

According to the priests Malik and Shafi’i, the child born after six months from the marriage of his mother and father, the child was preached to his father. If the child is born before six months, the child is sent to his mother.

In contrast to the opinion of Imam Abu Hanifa that the child out of wedlock remained in the preach to his father as a legitimate child.

Second, the child is fertilized and born outside of a legitimate marriage. The status of extramarital children in the second category is equated with the status of adulterous children and li’an children. Quoting Amir Syarifuddin in the book Hacking the Freezing Ijtihad, children born in this category have legal consequences:

Not having a relationship with his father, but having a relationship with his mother. His father had no obligation to provide for the child, but was biologically his son.

So the relationship that arises is only humane, not legal.

Do not inherit each other's property with his father, because the relationship of nasab is one of the causes of inheritance.

Fathers cannot be guardians of children outside marriage. If the child out of wedlock happens to be a woman and has grown up and will marry, then he has no right to be married by his biological father." Strictly Calista made his father's regret re-emerge in his heart.

This is the peak of Reza's regret that he had been worried about not being able to marry his two daughters on their happy day.

"The sources in this study are secondary data consisting of primary legal materials and secondary legal materials.

The primary legal material is the Qur’an, hadith, book or basic writing data taken from the book 4 schools and other books.

Secondary legal materials are data that support the source of official documents. According to Imam Abu Hanifah, that a child born outside of a valid marriage is a makhluqoh (created child) from the water ma*i his biological father, so it is forbidden for biological fathers to marry children of water ma*inya.

Meanwhile, according to Imam Shafi’i that the child born out of wedlock is an ajnabiyyah (foreigner) who is not at all nasabkan and does not have rights to his biological father, and it is legal for his biological father to marry a child born if a woman.

The legal method of Imam Abu Hanifa is based on the word of Allah letter an-Nisa verse 23, where the word “Banatukum” plural of Bintun is interpreted the meaning of lughawi which is meant by the child born from ****** the man from his conception.

While the legal method of Imam Shafi’i is based also on the word of Allah letter an-Nisa verse 23, the holiness as described in the verse is the fragrance caused by nasab rodho’ah, and mushaharah.

Then in relation to Islamic law in Indonesia, the opinion of Imam Abu Hanifah who prohibits marriage is more in accordance with what is applied in Indonesia, where the opinion is in line with the Constitutional Court Decision Number 46/THE PUU-VIII/2010. That is the forerunner of DNA tests arranged in contemporary fiqh according to the times and demands of human needs." Calista.

"It is better to marry us according to the rules of Islam by making Uncle Adam and Agam as our judges because our nasab is connected to the mother.

Those who are more worthy of us. We want uncle Agam and uncle Adam to the local religious office with our two future husbands brother Davin and prince Fatih to marry us legally.

We want our marriage to be in accordance with the rules of Islam that Allah and his apostles and father can marry us just to cover up the disgrace in front of our guests on the wedding day that has been determined after the religious marriage was already done by Agam's uncle who would marry Calista to Fatih's prince and Adam's uncle who would marry Camilla and Davin's brother." Camilla said to comfort her father.

Reza smiled again even though it did not make him relieved because he was just a formality to look perfect because of the many guests who did not know the ins and outs of the past of Reza and Andien.

"Well Camilla and Calista, tomorrow uncle will pick up your two future husbands at their hotel to the religious office, but before uncle will ask, have you told them all about your status?" Ask Adam.

"Euncle! when we just met again and a few days later we told him everything about our status as a father's son. And they don't mind it because they also understand the rules of Islam." Calista Timpal.

After the discussion, finally the Islamic marriage agreement was ready to be implemented the next day behind closed doors in the religious office took place simply without involving the other party just the family concerned. Acting as the guardian of her two daughters, Reza, is Andien's younger sister and their two marriage witnesses, Rendy and Jody.

Marriage is solemn by fulfilling the legal requirements of marriage according to the rules of Islam.

The rest of the two grooms can not do their first night before the second wedding is held as a formality only.

So their marriage book recorded there is their marriage guardian, Agam's uncle to Calista and Adam's uncle to Camilla.

At his second marriage, though, Reza had nothing to contribute to the marriage but to cover up the disgrace and it did not violate the rules of Islam because Islam forbids to indulge in disgrace in the presence of others. Although only a formality, but Reza still proudly married his two daughters in front of many invited guests.
