Women who have been proposed are often agreed as women who are almost legal to be a partner of a certain person before there are things that abort him.
Based on the book Bidayatul Mujtahid wa Nihayatul Muqtashid by Ibn Rushd explained, applying to women who have been proposed by people is prohibited as the Prophet Muhammad said in a shahih hadith. However, the clerics are at odds whether the ban shows the cancellation of prohibited acts or not? If yes, then under what circumstances does it happen?
According to Imam Dawud, the marriage was automatically annulled. According to Imam Shafi’i and Imam Abu Hanifah, the marriage was not void. Imam Malik has three versions of this opinion.
First, his opinion is the same as that of Imam Dawud which is void. Second, his opinion is the same as that of Imam Shafi’i and Imam Abu Hanifah. And in the third opinion, he argues that marriage is void if it occurs before the existence of bodily relations, and is not void if it occurs afterwards.
According to Ibn al-Qasim, the purpose of the prohibition is if a person who is pious proposes a proposal of fellow pious people. However, if a pious person proposes to an ungodly person, the law may.
But once the case applies for the application of others according to the majority of scholars, the law is illegal. This is as quoted by al-Hafizh in the book of Fathul Bari. In the book described, according to Al-Khittabi asserted that most jurists affirm the ban on it.
Prohibition is done because it prioritizes ethics. So that the prohibition is not an illegal ban that can cancel the agreement. While Imam An-Nawawi argues, the scholars agree that it is a prohibition that is illegal but nevertheless they disagree on the terms.
According to the scholars of the school of Imam Shafi’i and Imam Hambali, the law of raham is applied if the application has been answered firmly or the guardian has approved it. But if the application has been rejected firmly, then it does not become illegal.

For what is forbidden is the proposal itself, and it is not a valid condition of marriage. For this reason, this act cannot cancel the marriage contract.
The hadiths that affirm the prohibition include narrated by Imam Ahmad and Imam Muslim. The Hadith reads: “From Uqbah bin Amir, verily the Prophet said: a believer is a brother of another believer. A believer is not halal to sell for the sale of his brother, and is not halal to apply for his brother's proposal before he leaves,”.
Furthermore, the hadith narrated by Imam Bukhari and Imam An-Nasa’i nyang sourced from Abu Hurairah. The hadith reads: “Truly must not apply for someone else's proposal before he marries or leaves,”. The ban was also reaffirmed with the next hadith.
On the other hand regarding the time of application for application, most scholars argue that when there is a tendency from both sides, not at the beginning of the application. It is based on the hadith of Fatimah bint Qais.
At that time Fatimah came to meet the Prophet and told him that Abu Jahm bin Hudzaifah and Muawiyah bin Abu Sufyan had proposed to him. Then the Messenger of Allah said that means: “Abu Jahm is a person who is notoriously cruel. Muawiyah was a poor man who had no wealth. Therefore, marry Usama only,".
The Islamic woman had been proposed by another man and had accepted his proposal, so no other man could come to propose to her, until the first man cancels his application or allows others to propose because he can get a reply to hurt others in Islam, as stated by Imam Nawawi in Sharh Shohih Muslim, Cairo, Dar al Bayan, 1407/1987, volume 3, juz 9:197, as well as by Ibn Qudamah, in Al-Mughni, 10/567 .
The inscription is the hadith Abu Hurairah ra, that the Prophet said: “Do not ask for an Islamic woman who has been betrothed by his brother, and do not bargain for goods that his brother has bid for “ (H. R. Muslim, no : 2519 )
In the story of Ibn Umar ra, that he said : “ Prophet Muhammad had forbidden some of you to sell for his brother. And let no one ask for another bettor until the previous suitor leaves him, or he has been allowed the previous suitor.” (H. R. Bukhari, no.: 4746)
It's just that the scholars differ in interpreting the prohibition in the hadith above in accordance with the way of maintaining reason in Islam, some of them say that the prohibition shows a fragrance, the, while some others argue that the prohibition shows treason is not haram. Even Ibn Qasim of the Malikiyah madzhab said :
“ The purpose of the prohibition of hadith above, that is if a person who is sholeh proposes to an Islamic woman, then no other male can propose to her as well. As for if the first applicant is not a gentleman (fascist ), then it is permissible for men sholeh to apply for the Islamic woman. “ ( (Ibn Rushdi, Bidayah al Mujtahid, Beirut, Dar al Kolik al-Ilmiyah, 1988, cet to – 10 , juz : 2 /3 )
The silver lining is that the first suitor is not disappointed, because his proposal that has received it suddenly cancels it just because it came from another man, and this will potentially occur hostility, he said, hatred and revenge from one another.
